Article 23: Declaration of Incompatibility

If a court is satisfied that a provision of any law is incompatible with any of the rights or freedoms set out in this Part, it may make a declaration of that incompatibility.
Where a declaration of incompatibility is made, the law in question continues in force and effect, and is not invalidated, and the Legislature shall reconsider the provision.
